2. Your Contract With Us
A legally binding contract is formed when:
- You complete a booking through our website or authorised channel, and
- We issue a booking confirmation.
The person making the booking (“Lead Passenger”) confirms that:
- They are at least 18 years old,
- They have authority to accept these Booking Conditions on behalf of all travellers in the booking, and
- All passenger details provided are accurate and complete. The Lead Passenger is responsible for:
- All payments due under the booking,
- Communicating booking information to all travellers,
- Ensuring all travellers comply with these conditions.
3. Nature of Our Services
Voyage Elegante operates as a UK-based tour operator and travel organiser.
We provide travel services including, but not limited to:
- Accommodation
- Flights (including scheduled and charter services)
- Transfers
- Ground arrangements
- Packaged travel arrangements
- Dynamic packages created through our online booking platform
The legal nature of your booking depends on the services purchased.
3.1 Package Bookings (We Act as Organiser)
Where your booking includes two or more travel services (for example accommodation and flights, or accommodation and transfers) combined during a single booking process, this will generally constitute a “package” within the meaning of the Package Travel and Linked Travel Arrangements Regulations 2018
In such cases:
- Voyage Elegante acts as the Organiser.
- We accept responsibility for the proper performance of the travel services included in the package.
- Your booking may be protected under our ATOL licence where applicable.
Flights may be arranged via approved airline consolidators or global distribution systems (GDS). Regardless of sourcing method, where a package exists, Voyage Elegante remains responsible as Organiser.
3.2 Accommodation-Only Bookings (We Act as Agent)
Where your booking consists solely of accommodation, Voyage Elegante acts as an agent for the accommodation supplier.
In such cases:
- A contract is formed between you and the accommodation provider.
- The supplier’s terms and conditions apply in addition to these Booking Conditions.
- Our responsibility is limited to arranging the booking on your behalf.
Accommodation services may be sourced via third-party accommodation banks, bedbanks,
consolidators or technology partners. Hotel descriptions, facilities, ratings and images are
provided by suppliers and reflect local classification standards.
While we act as agent in accommodation-only bookings, we will use reasonable skill and
care in selecting suppliers and will provide reasonable assistance in the event of issues
arising during your stay.
Any assistance provided does not imply acceptance of legal liability.
4. Pricing & Availability
All prices displayed on our website are
- Dynamic
- Subject to live availability
- Subject to change until booking confirmation
Prices are confirmed only once a booking confirmation is issued.
We reserve the right to correct:
- Obvious pricing errors
- Technical errors
- System miscalculations
In the event of a manifest pricing error, we may:
- Offer the booking at the correct price, or
- Cancel the booking and refund any payments made
Currency conversions shown on the website are indicative only. Final charges may vary due to exchange rate fluctuations if applicable.
5. Payment
Payment terms will be clearly displayed at the time of booking.
Where a deposit is required:
- The balance must be paid by the specified due date.
- Failure to pay may result in cancellation.
Payments are processed through secure third-party payment providers. We are not responsible for:
- Payment gateway outages
- Banking delays
- Authorisation refusals
It is your responsibility to ensure sufficient funds are available.
If a chargeback is initiated without valid legal grounds, we reserve the right to recover any associated administrative and legal costs.
6. Amendments by You
If you wish to make changes to your booking after confirmation, you must notify us in writing as soon as possible.
6.1 Package Bookings
Where we act as Organiser:
- We will endeavour to accommodate reasonable requests.
- Changes are subject to availability.
- An administration fee may apply.
- Any additional costs imposed by airlines, hotels, or other suppliers must be paid by you.
Certain changes (such as date changes, destination changes, or name changes) may be treated as cancellation and rebooking.
Airline tickets (including those issued via consolidators or GDS systems) may be non-changeable and non-refundable, subject to airline fare rules.
6.2 Accommodation-Only Bookings
Where we act as agents:
- Amendments are subject to the supplier’s terms and conditions.
- We cannot guarantee that changes will be possible.
- Any amendment fees imposed by the supplier will be passed on to you.
- An administration fee may apply.
7. Cancellation by You
If you cancel your booking, cancellation charges will apply.
Cancellation must be notified in writing by the Lead Passenger.
7.1 Package Bookings
If you cancel a package holiday, cancellation charges will apply. Charges will depend on the date we receive your written cancellation notice.
Cancellation charges will be calculated based on the greater of:
- the cancellation charges imposed by the suppliers forming part of the package; and
- our reasonable administrative costs.
Certain components, including flights and promotional rates, may be non-refundable from the time of booking
Where a non-refundable deposit is specified at the time of booking, we reserve the right to retain that deposit.
Refunds will be processed once supplier confirmations have been received. Any refund due will be processed within a reasonable period once supplier refunds have been received, and may be subject to administrative processing times.
7.2 Accommodation-Only Bookings
If you cancel an accommodation-only booking or any standalone service, refunds are strictly subject to the cancellation terms of the relevant supplier as displayed at the time of booking.
We do not control supplier cancellation policies and do not assume liability for refund decisions made by the accommodation provider or airline.
Where applicable, reasonable administrative fees may apply.
Certain rates, including non-refundable or promotional rates, cannot be cancelled or amended.
8. Changes or Cancellation by Us
8.1 Package Bookings
We reserve the right to make minor changes to your booking.
Minor changes may include:
- Changes in flight times
- Changes in aircraft type
- Changes in accommodation within the same category
In the event of a significant change before departure, you may:
- Accept the change,
- Accept a replacement package (if available), or
- Cancel with a full refund.
Compensation may be payable except where changes are due to:
- Force majeure
- Insufficient minimum numbers (where applicable)
- Circumstances beyond our control
8.2 Accommodation-Only Bookings
Where we act as agent:
If the supplier cancels or changes your booking, we will inform you as soon as reasonably possible.
Our liability is limited to refunding monies received from the supplier.
9. Our Responsibility
9.1 Package Bookings
Where we act as Organizer, we are responsible for the proper performance of the travel services included in your package.
We are not liable for:
- Failures attributable to you,
- Failures attributable to a third party unconnected with the provision of the travel services,
- Unavoidable and extraordinary circumstances.
Our liability for damages (other than personal injury or death) is limited to three times the total package price. This limitation does not apply to cases involving death or personal injury caused by our negligence, or to any other circumstances in which liability cannot legally be limited under UK law.
We shall not be liable for any indirect or consequential losses, including loss of enjoyment, loss of profit, or business interruption.
9.2 Accommodation-Only Bookings
Where we act as agents:
Our responsibility is limited to exercising reasonable skill and care in arranging your booking.
We are not liable for:
- The acts or omissions of the accommodation provider,
- Service standards, maintenance issues, or facility availability,
- Classification or rating discrepancies.
We do not assume responsibility for the performance, quality, or delivery of the accommodation services themselves.
10. Force Majeure
We shall not be liable for failure to perform our contractual obligations where such failure is due to unavoidable and extraordinary circumstances beyond our control.
These may include, but are not limited to:
- War or threat of war
- Civil unrest
- Terrorism
- Natural disasters
- Pandemic or epidemic
- Government restrictions
- Air traffic control restrictions
- Airline operational decisions
In such circumstances, refunds will be subject to recovery from suppliers. We will use reasonable efforts to recover sums from suppliers on your behalf.
11. Complaints Procedure
If you encounter any issue during your travel arrangements, you must inform the relevant supplier (e.g. hotel, transfer provider, airline) immediately so that the issue can be addressed at the time.
You must also notify Voyage Elegante without undue delay.
Failure to report a problem promptly may affect our ability to investigate and resolve the matter and may reduce or extinguish any entitlement to compensation.
If your complaint remains unresolved, you must submit a formal written complaint within 28 days of the end of your travel arrangements. Failure to comply with this procedure may affect the outcome of your claim.
12. Website & Technical Disclaimer
Our website operates using live inventory supplied by third-party technology providers, accommodation banks, airlines, and global distribution systems (GDS).
As such:
- Availability is dynamic and subject to change until booking confirmation.
- Prices may change due to supplier updates.
- Hotel descriptions, ratings, facilities and images are provided by suppliers and reflect local standards.
- We cannot guarantee uninterrupted access to the website.
- We are not liable for temporary technical errors, system downtime, or external API disruptions beyond our control.
- We do not guarantee that the website will be free from viruses or other harmful components.
In the event of a manifest system or pricing error, we reserve the right to cancel the booking and refund any payments made. A manifest pricing error includes, but is not limited to, pricing that is obviously inconsistent with market value or supplier pricing.
13. ATOL & Financial Protection
Voyage Elegante holds an Air Travel Organiser’s Licence (ATOL).
When you purchase an ATOL-protected flight or package holiday from us, you will receive an ATOL Certificate.
This certificate sets out:
- What is financially protected.
- Where you can obtain further information.
- Who to contact if things go wrong.
- We cannot guarantee uninterrupted access to the website.
ATOL protection applies primarily to customers who book and pay in the United Kingdom.
Not all travel services sold by Voyage Elegante are protected by the ATOL scheme. The applicable protection will be clearly stated at the time of booking.

14. Passport, Visa & Health Requirements
It is your responsibility to ensure that you meet all passport, visa, immigration and health requirements applicable to your travel itinerary.
Passports must generally be valid for at least six months beyond the return date.
We do not accept liability where you are unable to travel due to failure to comply with these requirements.
You are responsible for checking official government travel advice before departure.
15. Flights & Air Passenger Rights
Flight timings are subject to change.
Under UK and EU law (Regulation EC261/2004), you may have rights in cases of flight delay, cancellation or denied boarding.
Any compensation under EC261 is the responsibility of the operating airline.
Compensation under EC261 does not automatically entitle you to a refund of your holiday cost from Voyage Elegante.
16. Governing Law & Jurisdiction
These Booking Conditions and any dispute arising from them shall be governed by and construed in accordance with the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
17. Severability
If any provision of these Booking Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
